Terms of Service

Version 2026-09-09

These terms are the agreement between you and [not yet configured] (ABN [not yet configured]), trading as DiecastBids. They apply whenever you use this site, whether you are browsing, bidding or selling. If you do not accept them, please do not use the service.

1. Eligibility and your account

  • You must be at least 18 and able to enter a binding contract.
  • You must give accurate registration details and keep them current. One account per person unless we agree otherwise in writing.
  • You are responsible for activity under your account. Keep your password secret and tell us promptly if you believe someone else has used it. You are not responsible for activity that results from our own failure to keep the service secure.

2. What this marketplace is — and your consumer rights

We operate a venue where collectors sell to each other. Except where a listing says otherwise, we are not the seller: the contract of sale is between the buyer and the seller. We do not take possession of items, inspect them or authenticate them, and we do not verify a seller’s description, condition grade, or claims about rarity or provenance.

This is a marketplace, not a traditional auction house — you deal with the seller, not with an auctioneer acting as their agent. That matters for your rights:

  • If the seller is in trade or commerce — a dealer, a shop, or anyone selling regularly enough to be running a business — the consumer guarantees in the Australian Consumer Law apply to what you buy. The goods must be of acceptable quality, match their description, and be fit for any purpose the seller said they were fit for.
  • If the seller is a private collector selling from their own collection, most consumer guarantees do not apply to that sale, because they are not supplying in trade or commerce. Our Returns and Refunds Policy is what protects you in that case, and it applies to every sale on the site.
  • Our own service to you is supplied in trade or commerce, so the consumer guarantees apply to it in every case. See section 12.

Catalogue values and market figures on this site are estimates derived from past activity. They are information, not an appraisal, a valuation, or financial or investment advice, and you should not treat them as a prediction of what an item will sell for.

3. Bidding

  • A bid is a binding offer. If you are the highest bidder when an auction closes and any reserve is met, you are committed to buy at that price.
  • Bids cannot normally be retracted. If you believe you bid in error, contact us immediately — we will consider it, but we are not obliged to cancel a bid.
  • A bid placed in the final 30 seconds extends the auction by a further 60 seconds, so a late bid always leaves others a chance to respond. This applies to every bidder equally.
  • Where a seller has set a reserve, no sale takes place unless bidding reaches it, even if the auction has a highest bidder.
  • For bids above A$50 we require a verified payment method on file before the bid is accepted. This keeps bidding real; you are not charged at the time of bidding.

4. Selling

By listing an item you confirm, for that item, that:

  • you own it outright, or are authorised to sell it, and it is free of any security interest;
  • it is genuine and described accurately, including condition, packaging, any damage, repair or restoration, and whether it is a variant, replica or custom;
  • every photograph is one you took or hold the rights to use — not a manufacturer press image, another seller’s photograph, or an image taken from a catalogue site;
  • selling it is lawful where you are and where you are sending it, it is not counterfeit, and it is not subject to a recall or a product safety ban;
  • you will dispatch it promptly once payment clears, and provide tracking where the service requires it.

If you sell in trade or commerce — including where you sell regularly, buy with the intention of reselling, or otherwise operate as a business — you have obligations under the Australian Consumer Law to the people who buy from you, including the consumer guarantees and the prohibition on misleading conduct. Those obligations are yours, not ours, and you cannot contract out of them. If you are unsure which side of the line you are on, get advice.

You grant us a non-exclusive, royalty-free licence to host, resize and display the images and text you upload, for the purpose of operating and promoting the marketplace, and to retain them in a closed listing as a record of what was sold. You keep ownership of your content. The licence ends when you remove the content, except for closed-listing records, which we keep for the retention period in our Privacy Policy.

5. Fees

Buyers pay the winning bid plus shipping. Sellers pay a commission on the sale price, deducted before payout, at the rate for their tier:

A minimum commission of A$0.50 applies to every sale. All amounts on this site are in Australian dollars and include GST where GST applies. Payment processing is handled by Stripe, whose own charges may apply to payouts.

We will give you at least 30 days’ notice before any increase in fees takes effect. An increase applies only to listings created after it takes effect, never to a sale already under way. If you do not accept a change you can close your account before it starts.

6. Payment, holding of funds, and payout

  • Payments and payouts are processed by Stripe. We never hold your card details.
  • Buyer funds are held until the order completes. Where a seller marks a parcel as posted and the buyer neither confirms receipt nor raises a problem, we treat it as delivered after 7 days.
  • After delivery there is an inspection window of 72 hours before funds are released to the seller. Confirming receipt yourself ends that window early.
  • Sellers in our top tiers are paid at dispatch rather than after delivery. Where that applies it is shown in the seller’s payout panel.
  • Opening a dispute during the inspection window holds the funds until the dispute is resolved.

Holding funds in this way is a service we provide to make trading safer. We are not a bank, we do not hold your money on deposit, and we do not pay interest on funds held.

7. Returns, refunds and disputes

These are set out in our Returns and Refunds Policy, which forms part of these terms.

8. Things you must not do

  • Bid on your own listing, or arrange for anyone else to bid on it, to inflate the price (shill bidding). This is also a breach of the Australian Consumer Law. We monitor for coordinated bidding and will act on it.
  • Arrange a sale off-platform to avoid fees after making contact through the site.
  • List counterfeit items, or describe a replica or custom as an original.
  • Post another person’s images, text or personal information.
  • Scrape, crawl or bulk-download the catalogue, or automate bidding.
  • Interfere with the security of the site or attempt to access another user’s account.

9. Intellectual property and takedown

DiecastBids is an independent marketplace for collectors. It is not affiliated with, endorsed by, or sponsored by Mattel, Inc. or any other manufacturer. “Hot Wheels”, “Matchbox” and all other product and brand names are the property of their respective owners, and are used on this site only to identify the collectibles being bought and sold.

If you believe material on this site infringes your copyright or trademark, send a notice to [not yet configured] identifying the work, the listing or URL complained of, your contact details, and a statement that you are the rights holder or authorised to act for them and that you believe the use is not authorised. We will assess it promptly, remove or disable material where the notice is properly made, and notify the user who posted it, who may respond. We terminate the accounts of repeat infringers.

10. Suspension and closure

We may suspend or close an account, remove a listing, or reverse a transaction where we reasonably believe these terms have been breached, where there is fraud or a risk to other users, or where the law requires it. We will tell you what we have done and why, and give you a reasonable opportunity to respond, unless telling you would prejudice an investigation or we are prevented by law. Where a suspension turns out to be unjustified we will lift it and restore your listings.

You can close your account at any time. Obligations under trades already in progress survive closure, and funds held for a completed sale are still paid out.

11. Availability and changes to the service

We aim to keep the service running but do not guarantee it will be uninterrupted or error-free, and we may change or withdraw features. Where a failure on our side causes an auction to close incorrectly, we may extend, void or re-run that auction, and we will tell the affected bidders and the seller why.

12. Consumer guarantees and liability

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies those guarantees, or any other right or remedy you have under a law that cannot be excluded. If we fail to meet a consumer guarantee, you are entitled to the remedies the Australian Consumer Law gives you.

To the extent the law allows us to limit our liability, and subject to the paragraph above:

  • we are not liable for the acts or omissions of a buyer or seller, or for the condition, authenticity, description or value of an item listed by someone else;
  • we are not liable for loss that was not reasonably foreseeable, or for loss caused by something outside our reasonable control;
  • we are not liable for loss you could have avoided by taking reasonable steps, including reading the listing and raising a problem within the inspection window;
  • our liability is reduced to the extent your own act or omission caused or contributed to the loss.

Nothing here limits our liability for death or personal injury caused by our negligence, or for fraud.

13. Sellers’ responsibility for their own listings

If you list an item and a claim is made against us because that item was counterfeit, misdescribed, not yours to sell, or infringed someone’s rights, you are responsible for our reasonable direct losses and legal costs in dealing with that claim. This does not apply to the extent the claim arises from our own negligence or breach, and we will tell you about any such claim promptly and let you take part in how it is handled.

14. Changes to these terms

We may change these terms where there is a genuine reason to — a change in the law, a change to the service, or to address a risk. We will give registered users at least 30 days’ notice of a change that materially affects your rights, and the version and date at the top of this page always show the current text. If you do not accept a change, you may close your account before it takes effect; the change will not apply to a transaction already under way.

15. If something goes wrong between us

Tell us first at [not yet configured]. We will acknowledge within 5 business days and try to resolve it with you directly, because that is almost always faster than anything else.

Nothing in these terms stops you taking a complaint to the consumer protection agency in your state or territory, to the ACCC, or to a tribunal or court — including a small claims tribunal such as NCAT, VCAT or QCAT. You do not have to come to us first before doing that.

16. Governing law

These terms are governed by the laws of [not yet configured] and the Commonwealth of Australia. You and we submit to the non-exclusive jurisdiction of the courts and tribunals of that place. Nothing in this clause prevents you from bringing a claim in the place where you live, if the law entitles you to.
